Client Agreement & Terms of Service

Please review the terms below before starting your project. By purchasing a package or submitting a project request, you agree to all of the following.

1. Introduction

By purchasing a website package or submitting a project request to Strategic Web Design (the "Developer"), you (the "Client") agree to all of the terms outlined in this Client Agreement and Terms of Service.

2. Scope of Work

  • Website design includes only the pages and features agreed upon in writing at the start of the project.
  • Any additional requests outside the original scope will require additional fees and a revised timeline.
  • Content, images, copy, and branding materials must be provided by the Client unless otherwise agreed in writing.

3. Payment Terms

  • A deposit is required before any work begins.
  • The remaining balance is due before the final website is launched or transferred.
  • Deposits are non-refundable once work has started.

4. Revision Policy

  • Up to two (2) rounds of revisions are included with every project.
  • Additional revisions beyond the included rounds will be billed separately at the Developer's standard rate.

5. Timeline and Delays

  • Project timelines depend on timely Client communication and content delivery.
  • Delays caused by the Client (late content, slow approvals, unresponsive communication) will extend project deadlines accordingly.

6. Domain Ownership

  • The Client is responsible for purchasing, renewing, and maintaining ownership of their domain name.
  • The Developer is not responsible for expired domains, registrar issues, or any consequences resulting from lost domain control.

7. Hosting and Platform Terms

  • The website may be hosted on Developer-managed infrastructure as part of the project.
  • The Developer retains platform administrative access unless ownership is transferred to the Client through a written agreement.
  • The Client understands that third-party platform limitations, terms, and outages may apply and are outside of the Developer's control.

8. Maintenance and Support

  • Thirty (30) days of minor support are included after launch unless otherwise agreed in writing.
  • Ongoing maintenance, content updates, and new feature work require a separate maintenance plan or hourly billing.

9. Liability Limitation

The Developer is not liable for lost revenue, business interruption, platform outages, domain issues, hosting issues, hacked or compromised third-party integrations, or changes made by the Client or anyone other than the Developer.

The Developer's maximum liability under this agreement is limited to the total amount paid by the Client for the project.

10. Termination

  • The Developer may terminate service for abuse, non-payment, or breach of these terms.
  • The Client may terminate the project before work begins, subject to the deposit policy described above.

11. Refund Policy

  • No refunds will be issued after substantial work has begun on the project.
  • Refund decisions are made at the sole discretion of the Developer, unless a refund is required by applicable law.
